CONYNGHAM TOWNSHIP ANTI-LITTERING ORDINANCE


ADOPTED APRIL 1 1972


ORDINANCE NO. 1-72

AN ORDINANCE PROHIBITING THE THROWING OR DROPPING OF TRASH OR RUBBISH OF ANY KIND UPON THE STREET, HIGHWAY OR PUBLIC PLACE, OR UPON THE LAND OF ANOTHER, AND PRESCRIBING PENALTIES FOR VIOLATIONS.

BE IT ORDAINED AND ENACTED by the Board of Supervisors of Conyngham Township
as follows:

Section 1. Short Title. This ordinance shall be known and may be cited as the Conyngham Township "Anti-Littering Ordinance."

Section 2. No person, firm, corporation or association shall throw, drop, or cause to be thrown or dropped upon any street or highway or other public place or upon the land of another, any garbage, bottles, waste paper, cans, wood cartons, ashes, metal or metal sweepings, wire, glass, hand-bills, cardboard, containers of any kind, mails, discarded or soiled personal property, trash or rubbish of any kind, nor interfere with, scatter or disturb the contents of any receptacle containing garbage, ashes, household wastes or rubbish which has been placed upon any sidewalk or elsewhere for the collection of the contents thereof.

Section 3. Sweeping Litter Into Gutters Prohibited. No person shall sweep into or deposit in any gutter, street or other public place within the Township, the accumulation of litter from any building or lot or from any public or private sidewalk or driveway. Persons owning or occupying places of business within the Township shall keep the sidewalks in front of their businesses free from litter. Litter retained temporarily on any premises shall be stored in a suitable container.

Section 4. Violations. Any person or firm or corporation who or which shall violate any or all of the provisions of the Ordinance shall upon conviction thereof, be sentenced to pay a fine of not less than $25.00 nor more than $100.00 for each and every such offence, which shall be collected by summary proceedings brought in the name of the Township before any Justice of The Peace. In default of the payment of said fine and costs, such persons may be sentenced and committed to the Columbia County Jail for a period not exceeding ten (10) days.

Section 5. Separability. If any section, subsection, sentence, clause or portion of the Ordinance is for any reason held invalid by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions hereof.

Section 6. Ordinance Repealed. All Ordinances and parts of Ordinances in conflict with the provisions of this Ordinance are hereby repealed.
