Conyngham Township Curfew Ordinance

CURFEW ORDINANCE

AN ORDINANCE PROVIDING FOR A CURFEW
IN THE TOWNSHIP OF CONYNGHAM
AND PRESCRIBING PENALTIES FOR ITS VIOLATION


BE IT ENACTED AND ORDAINED by the Board of Supervisors of the
Township of Conyngham, Columbia County, Pennsylvania, and the same
is hereby enacted and ordained by the authority of the same as follows: that:


SECTION 1. It shall be unlawful for any person under eighteen (18) years of age to be or remain upon any street or alley or other public place in the Township of Conyngham at night after 10:30 P.M. unless such person is accompanied by a parent or guardian, or other person having custody of such minor or unless in the performance of duty directed by such parent or guardian or unless such person is in lawful employment making it necessary to be in such places after 10:30 P.M.

SECTION 2. It shall be unlawful for anyone having the legal care and custody of any person as described above to allow or permit such person to go or be upon any public street, alley or other public place in the Township of Conyngham in the night time as restricted in the preceeding section, except in the case of necessity.

SECTION 3. The policemen shall take any child violating Section 1 of this ordinance to the home of the parent, guardian or other person having the legal care and custody of such child, and the parent, or guardian or other person aforesaid shall be proceeded against.

SECTION 4. Any person violating any of the provisions of this ordinance shall, upon conviction thereof before the Magistrate of the magisterial district of which the Township of Conyngham is a part, be sentenced to pay a fine of not less than Five ($5.00) Dollars, and costs, or undergo imprisonment for a period not exceeding ninety (90) days, or both.

SECTION 5. In the event that any phrase or clause of this ordinance shall be deemed invalid or unconstitutional by any court of competent jurisdiction, the validity of such phrase or clause shall in no way affect any other phrase or clause herein contained.

SECTION 6. All Ordinances and parts of Ordinances inconsistent herewith be and the same are hereby expressly repealed.
