Conyngham Township Snow Emergency Ordinance


ADOPTED OCTOBER 7 1982


AN ORDINANCE OF THE TOWNSHIP OF CONYNGHAM, AUTHORIZING THE REGULATION
OF TRAFFIC AND PARKING DURING SNOW EMERGENCIES; PROVIDING PENALTIES



BE IT ENACTED AND ORDAINED by the Board of Supervisors of the Township of Conyngham, Columbia County, Pennsylvania, and it is hereby enacted and ordained by the authority of the same:


SECTION I. The following words when used in this Ordinance shall unless the context clearly indicates otherwise, mean as follows:

a. "Street" means every way or place of whatever nature, within the Township of Conyngham, open to the use of the public as a matter of right for the purpose of vehicular travel.
b. "Vehicle" any device in, upon, or by which any person or property is or may be transported, driven, or drawn upon a public street.
c.Person” any person, firm, partnership, association or corporation.
d.Township” the Township of Conyngham.


SECTION II. A snow emergency shall be deemed to exist whenever:

a. there is an accumulation of snow on the streets of the Township to a depth of two (2) inches or more, or that an accumulation of two (2) or more inches of snow is reasonably foreseeable, or
b. the Chairman of the Board of Supervisors of the Township declares a snow emergency to exist. The Chairman is authorized to declare a snow emergency to exist whenever he receives, from a recognized forecasting service, a firm forecast of snow, the accumulation of which would be equal to or exceed two (2) inches, and gives effective notice thereof by issuing press releases to local radio stations and newspapers, which notice shall be effective upon broadcasting or publication.


SECTION III. The snow emergency shall continue in full force and effect until:

a. the snow has been removed from the streets of the Township, or
b. the Chairman of the Board of Supervisors declares an end to the emergency and gives notice thereof by issuing press releases to the local radio stations and newspapers, which notice shall be effective upon broadcasting or publication.



STREETS


SECTION IV. Whenever a snow emergency is deemed to exist under section II above, the following parking and traffic regulations shall become effective:

a. All residential homes and businesses having driveways from the streets or off-street parking shall use such parking facilities and not park on the streets and remain parked off the streets until such time as the snow has been removed there from.
b. All other occupants of residences or places of business abutting any street, and all owners or drivers of any vehicles located or parked within the Township during a snow emergency shall park their vehicle or vehicles on the north & east side of the streets and remain so parked until the south and west side of the street has been cleared of snow.
c. It shall be unlawful to drive any vehicle into or upon any street so as to interfere with the snow removal and the equipment used for such purpose.


SECTION V. Signs giving notice of the snow emergency parking regulations shall be posted in a conspicuous manner, according to law, on all streets in the Township.


SECTION VI. Any vehicle parked in violation of Section IV of this Ordinance may be removed by any member of the Township Police Department or his designee. Any vehicle removed may be towed to and placed at any area designated by the Chairman of the Board of Supervisors of the Township or his duly designated representative, for impounding vehicles. All costs for removal, towing, storage or parking of any vehicle removed under the provisions of this Ordinance shall be paid by the owner of said vehicle and the vehicle shall remain impounded until all such costs are paid. The above charges shall be in addition to any fine and costs imposed.


SECTION VII. Any person violating Section IV of this Ordinance shall, upon conviction thereof, be fined a sum of not less than fifteen ($15.00) Dollars nor more than Twenty-five ($25.00) Dollars, plus costs, and upon failure to pay the fine and costs to be committed to the County jail for not more than three (3) days. Each day during which the violation continues shall be deemed a separate offense.


SECTION VIII. In the event that any phrase or clause of this Ordinance shall be held invalid or unconstitutional by any Court of competent jurisdiction, the invalidity of such phrase or clause shall in no way affect any other phrase or clause herein contained.


SECTION IX. Any Ordinance or parts of Ordinances inconsistent herewith be and the same are hereby expressly repealed.


SECTION X. This Ordinance shall become effective thirty (30) days from the enactment hereof.
